MY STROLLER SOLUTION and the LESSEE, identified and qualified in the reservation database, hereby agree to the following conditions governing the provision of rental services for products and equipment:
Clause 1 – USAGE TERMS
1.1. This contract grants the LESSEE the right to rent on the MY STROLLER SOLUTION website, for a minimum period of 4 (four) to a maximum period of 31 (thirty-one) days, one or several products simultaneously. Rental rates are differentiated and organized with product images on the website www.mystrollersolution.com.
1.1.1. This contract does not concern the purchase and sale of a product, and MY STROLLER SOLUTION remains the sole owner of all products available for rent. The LESSEE acknowledges that the equipment is for personal use only. By consenting to the terms and conditions of this rental contract, the LESSEE, who is of legal age and fully capable, acknowledges having read, understood, and agreed to the terms and conditions described below.
1.2. The provision of the service under this contract is restricted to the Orlando area and surroundings, Florida, as informed on the website. It is the LESSEE's responsibility to verify if their accommodation location is included in the service areas.
1.3. MY STROLLER SOLUTION reserves the right not to make deliveries to some addresses within the covered area, and in this case, the LESSEE will be notified through the contacts provided in their registration. In this case, the paid amount will be 100% refunded.
1.4. MY STROLLER SOLUTION carries out deliveries and collections by prior reservation and scheduling.
1.5. MY STROLLER SOLUTION warns the LESSEE of its right to change any condition of this Usage Terms at its sole discretion at any time. The current version of this document will be available on the website www.mystrollersolution.com, in the Terms of Use section. The continued use of the contracted service will imply acceptance of any changes by MY STROLLER SOLUTION.
Clause 2 – REGISTRATION AND ONLINE RENTAL
2.1. To contract the product rental service, the LESSEE must fill out the reservation form on the website www.mystrollersolution.com. The LESSEE hereby declares that the information provided in the registration is entirely truthful and agrees to update it whenever there is any change in the information.
2.2. MY STROLLER SOLUTION undertakes to maintain the confidentiality and security of the LESSEE's information and not to disclose their registration data to third parties. Only when this information is necessary for the billing process or participation in promotions, which is hereby authorized by the LESSEE.
2.3. When requesting the first rental, the LESSEE will undergo a registration analysis to confirm the data provided for their own security.
2.4. The LESSEE will navigate the website, add the products they wish to rent, and choose the period they would like to keep each of them.
2.4.1. Once the desired products are added to the cart, the LESSEE must complete the order and make the payment through credit/debit card.
2.5. At the time of reservation, the LESSEE will specify the name and address of the resort, hotel, or vacation home in the Orlando area where the product(s) will be delivered and subsequently collected.
2.6. In case of unavailability of one or more rented products, for any reason, MY STROLLER SOLUTION will allow the LESSEE to choose to be refunded 100% of the value of the unavailable products or to replace them with other products of the same value.
2.7. In the event of cancellation of the rental communicated at least 7 (seven) business days before the delivery of the products, the refund of the amount paid will be made through a chargeback with the credit card issuer used by the LESSEE, with the amount refunded as a credit on their next statement. In the impossibility of chargeback with the payment intermediaries, MY STROLLER SOLUTION reserves the right to deduct the fees charged by financial institutions and credit card issuers and reimburse the amount within 30 (thirty) business days.
2.7.1. In the absence of cancellation communication with the minimum period of 7 (seven) business days, MY STROLLER SOLUTION will charge a penalty of US$ 25.00 (Single stroller) and US$ 35.00 (Double stroller), charged for each rented unit.
Clause 3 – DELIVERY
3.1. The delivery will be made at the location and day indicated in the reservation made on our website.
3.1.1. MY STROLLER SOLUTION will deliver to the LESSEE, at the reception of the resort, hotel, or rental home, free of charge if it is within an 8 (eight) mile radius of the Walt Disney World Resort. Beyond this distance, a fee of US$ 15.00 will be charged for each leg (delivery and collection).
3.1.2. MY STROLLER SOLUTION will make the delivery on the day indicated by the LESSEE in their reservation request until 11 (eleven) in the morning.
3.1.3. If the LESSEE needs to receive at a specific time, they must contact MY STROLLER SOLUTION, which will verify the possibility of accommodating such request.
3.2. The LESSEE acknowledges that all deliveries are made within predetermined time intervals and that any delays due to traffic or force majeure may occur.
3.3. MY STROLLER SOLUTION may reschedule the delivery date and time due to extreme situations such as hurricanes, tropical storms, heavy rains, tornado warnings, and winds exceeding 25 mph.
3.4. If delivery cannot be completed due to refusal to receive at the location indicated by the LESSEE and a second delivery trip is necessary, a fee of US$ 20.00 will be charged.
3.5. MY STROLLER SOLUTION agrees to wait for a maximum of 15 (fifteen) minutes to make the delivery of the rented products, in situations where hand delivery is required or hand delivery was previously agreed upon. In the event that delivery is not possible and a second delivery trip is necessary, a fee of US$ 20.00 will be charged.
Clause 4 – RENTAL DURATION
4.1. MY STROLLER SOLUTION is not responsible for the incorrect use of the products, and they must be used according to the manufacturer's instructions and under adult supervision at all times.
4.2. The LESSEE is entirely responsible for the custody of the products. Items left improperly in parks or inappropriate locations will be considered abandoned, and an additional fee of US$ 30.00 will be charged for their recovery. In the impossibility of recovering the abandoned items, a replacement value will be charged and debited to the LESSEE's credit card.
4.3. The products must be returned entirely clean, i.e., without traces of paint, slime, bodily fluids, food, or other dirt incompatible with regular use, under penalty of a fine of US$ 350.00 per dirty product.
Clause 5 – INSURANCE
5.1. MY STROLLER SOLUTION offers the option to contract insurance against theft, robbery, and minor damages. The contracting is optional and must be done at the time of renting the products.
5.1.1. Insurance cannot be contracted after the delivery of the rented items.
5.1.2. The insurance fee is non-refundable.
5.2. The insurance covers: scratches on the structure, flat tires, minor dents on the frame, as well as theft and robbery (upon police report).
5.3. The insurance does not cover:
5.3.1. Abandonment of the rented product(s) by the LESSEE during the rental period.
5.3.2. Delay exceeding 2 (two) hours on the LESSEE's part to notify the Park's Security and MY STROLLER SOLUTION of the theft or loss of the rented item(s).
5.3.3. Stains from sunscreens, bodily fluids such as urine, vomit, and feces, creams, hair spray, pens, markers, and slime.
5.3.4. The insurance does not cover abandonment of items in parks, public places, or outside the previously agreed-upon location, nor damages caused by misuse of the items.
5.3.5. The loss or damage of any of the accessories (rain cover, object bag, or tray).
5.4. The LESSEE, in the situation of not contracting insurance, declares to be aware that the purchase value of new items for the replacement of stolen or robbed products will be debited to their credit card.
5.4.1. In the case of repairable damages, the LESSEE's credit card will be debited with the value for repair or replacement of the part.
5.5. The LESSEE must present the occurrence report for loss or theft prepared by the park security or the police report when it occurs outside the parks to activate the insurance.
Clause 6 – COLLECTION
6.1. The rented products will be collected on the rental expiration date, at the same delivery address, unless otherwise indicated at the time of rental.
6.1.1. The LESSEE must make the rented products available by 10 (ten) in the morning on the date specified as the final rental date. MY STROLLER SOLUTION collects from 10 (ten) in the morning on the date indicated by the LESSEE as the rental end date.
6.1.2. In the event that collection cannot be completed at the location indicated by the LESSEE and a second delivery trip is necessary, a fee of US$ 20.00 will be charged.
6.2. The LESSEE must ensure that all rented items are available for collection at the resort, hotel, or vacation home designated on the specified date in the reservation. For resorts with protocols, this must be sent through the WhatsApp application to +1 (689) 287-9027. All rental items must be returned at the house entrance or at the resort or hotel check-in counter listed in the confirmation email. Rental items left in rooms will incur a recovery fee of US$ 50.00. The LESSEE is 100% responsible for the availability of items at the reception for pickup at the scheduled contract end time. Rental items being returned from vacation homes, we recommend scheduling via WhatsApp message for hand delivery.
Clause 7 - DAMAGES AND LOSSES
7.1. The LESSEE is responsible for any damages that occur to the products while they are in their possession, agreeing that if there is damage, destruction, loss, or total inutility of the same, they will pay the total value for replacement or repair of any rented item in cases where such damages are not covered by insurance (if contracted).
7.1.1. The LESSEE agrees to authorize the debit on their credit card for the total value of the replacement or repair of any rented item in the situation described in clause 7.1.
Clause 8 - PAYMENT AND BILLING
8.1. Payment must be made at the time of booking the rented products, by credit card. The billing information used will be the same as provided by the LESSEE at the time of contracting, unless later modified.
8.2. The Rental will become effective only after payment confirmation. Products will only be delivered after payment confirmation.
Clause 9 – ADDITIONAL INFORMATION
9.1. LESSEES who voluntarily send photos and videos of children and babies playing with products rented from MY STROLLER SOLUTION agree and authorize in advance all copyright rights of image use by MY STROLLER SOLUTION for the promotion of our products and services on social media, even for commercial purposes.
9.2. Discount codes provided by MY STROLLER SOLUTION and/or partners are not cumulative.
